भारत के Goods and Services Tax system में October 2026 एक बड़े policy shift का महीना बन गया है। 57th GST Council ने GST enforcement और compliance framework में कई महत्वपूर्ण reforms की recommendation की है। इनमें सबसे ज्यादा चर्चा GST officers की arrest power हटाने के फैसले की है।
Council ने CGST Act की Section 69 को हटाने की recommendation की है, जिसके साथ GST के तहत tax officers की arrest power समाप्त हो जाएगी। इसके साथ prosecution की monetary threshold को ₹1 crore से बढ़ाकर ₹5 crore करने की भी recommendation की गई है।
यह बदलाव सिर्फ एक legal provision को हटाने तक सीमित नहीं है। इसका broader message यह है कि GST administration को punitive enforcement से ज्यादा technology, compliance और trust-based taxation की दिशा में ले जाने की कोशिश हो रही है।
आखिर Arrest Power हटाने की जरूरत क्यों पड़ी?
GST लागू होने के बाद tax evasion और fake input tax credit जैसे मामलों से निपटने के लिए authorities को काफी मजबूत enforcement powers दी गई थीं।
समय के साथ business groups की तरफ से यह concern सामने आता रहा कि tax disputes और genuine compliance issues में criminal enforcement का डर business environment को प्रभावित कर सकता है।
57th GST Council से पहले भी arrest provisions को लेकर debate हुई थी। कुछ राज्यों ने officers की enforcement powers कम करने पर चिंता जताई थी, जबकि reform के समर्थकों का तर्क था कि commercial या interpretational disputes को criminal action की दिशा में नहीं जाना चाहिए।
अब Council ने Section 69 को omit करने की recommendation देकर इस debate को एक नए stage पर पहुंचा दिया है।
क्या इसका मतलब GST चोरी पर अब गिरफ्तारी बिल्कुल नहीं होगी?
यहां एक important distinction समझना जरूरी है।
Arrest power हटाने का मतलब यह नहीं है कि GST fraud या tax evasion को legal consequence से बाहर कर दिया गया है।
Council ने prosecution provisions को पूरी तरह खत्म नहीं किया है। बल्कि prosecution की threshold को ₹1 crore से बढ़ाकर ₹5 crore करने की recommendation की गई है।
इसके अलावा Section 132 के तहत कई offence provisions को rationalise करने का प्रस्ताव है, जिसमें fraudulent ITC claims को ज्यादा clearly define करने और punishment structure को rationalise करने की बात कही गई है।
यानी नया approach roughly यह दिखाई देता है:
Compliance issue → Tax recovery / interest / penalty
जबकि गंभीर और निर्धारित criminal offences के लिए:
Fraud → Prosecution
इससे हर tax dispute को criminal enforcement के lens से देखने की संभावना कम हो सकती है।
Business के लिए सबसे बड़ा बदलाव क्या होगा?
सबसे बड़ा impact business confidence पर पड़ सकता है।
GST compliance में businesses को registration, returns, ITC, refunds, notices और assessments जैसे कई stages से गुजरना पड़ता है।
अगर इन processes में छोटी procedural mistakes या genuine interpretation disputes सीधे aggressive enforcement risk में बदलने की संभावना कम होती है, तो businesses के लिए regulatory environment ज्यादा predictable हो सकता है।
विशेषकर MSMEs, startups और small traders के लिए यह important है, क्योंकि बड़े corporations की तुलना में उनके पास tax litigation और compliance management के लिए limited resources होते हैं।
GST Council का broader objective भी compliance को simplify करके businesses के लिए time और cost कम करना है।
GST 2.0 अब सिर्फ Tax Rates की कहानी नहीं
GST reforms के पहले phase में focus largely tax rates और rate rationalisation पर रहा।
लेकिन 57th GST Council का focus अलग दिखाई देता है।
अब discussion में शामिल हैं:
- Faster GST refunds
- Easier registration
- Simplified returns
- Common standards for notices
- Input Tax Credit reforms
- Easier export procedures
- E-commerce sellers के लिए simplified registration
- Goods movement को ज्यादा targeted बनाना
- Tax disputes और prosecution को rationalise करना
PIB के अनुसार Council ने registration, returns, refunds और adjudication से जुड़े process reforms के साथ trade facilitation और compliance simplification पर भी recommendations दी हैं।
इसलिए GST 2.0 का अगला phase सिर्फ “कितना tax लगेगा” नहीं, बल्कि “tax system के साथ business कैसे interact करेगा” इस सवाल पर ज्यादा focused हो सकता है।
Tax Officials की Power कम होगी तो Tax Evasion कैसे रोका जाएगा?
यही इस reform का सबसे बड़ा challenge भी है।
अगर enforcement powers कम होती हैं, तो सरकार को यह सुनिश्चित करना होगा कि genuine tax evasion करने वालों के खिलाफ action कमजोर न पड़े।
इसीलिए Council ने दूसरी तरफ intelligence-based enforcement को मजबूत करने की recommendation की है।
उदाहरण के लिए goods-carrying vehicles की interception को specific intelligence और authorised officer की approval से जोड़ने का प्रस्ताव है। यानी random या routine intervention की जगह data-driven enforcement पर ज्यादा जोर दिया जा रहा है।
यह GST administration के future model की तरफ इशारा करता है:
More Technology + Better Data + Targeted Enforcement
और
Less Manual Intervention + Less Arbitrary Pressure
Refund और Working Capital में भी राहत
GST system में businesses के लिए एक बड़ा practical issue refund delays और blocked working capital रहा है।
57th Council ने faster, system-based GST refund processing की recommendation की है। इसके अलावा inverted duty structure से जुड़े refund eligibility में भी विस्तार की recommendations की गई हैं।
Manufacturers और exporters के लिए इसका direct impact working capital पर पड़ सकता है।
अगर refund process faster होता है, तो businesses का पैसा लंबे समय तक tax system में blocked नहीं रहेगा।
यह खास तौर पर उन sectors के लिए महत्वपूर्ण है जहां input cost और output GST structure के बीच mismatch के कारण ITC accumulation होता है।
Small Businesses और E-commerce Sellers के लिए क्या बदलेगा?
57th Council ने छोटे e-commerce sellers के लिए GST registration process को भी simplify करने की recommendation की है।
इसके अलावा Council ने ₹5 crore तक turnover वाले small consumer-facing businesses के लिए एक optional scheme को in-principle approve किया है।
इसका उद्देश्य small businesses के लिए compliance burden को कम करना और formal digital economy में उनकी participation को आसान बनाना है।
E-commerce के बढ़ते influence के बीच यह change छोटे sellers के लिए खासा महत्वपूर्ण हो सकता है।
Penalty और Prosecution में भी बदलाव
Arrest power के अलावा Council ने penalties को भी rationalise करने की recommendation की है।
General penalty को ₹25,000 से घटाकर ₹10,000 करने का प्रस्ताव है।
साथ ही prosecution threshold को ₹1 crore से ₹5 crore करने का मतलब यह है कि lower-value cases में criminal prosecution का risk कम हो सकता है, जबकि serious financial fraud पर prosecution की व्यवस्था बनी रहेगी।
यह approach tax administration को proportionality की तरफ ले जाने की कोशिश के रूप में देखा जा सकता है।
लेकिन States की चिंता भी महत्वपूर्ण है
इस reform को केवल business relief के तौर पर देखना पूरी तस्वीर नहीं होगी।
GST एक Centre-State tax framework है और tax enforcement में राज्यों की भी बड़ी भूमिका है।
57th Council की meeting से पहले Maharashtra, Gujarat, Uttar Pradesh, Karnataka और Andhra Pradesh जैसे राज्यों की तरफ से arrest powers को पूरी तरह हटाने पर concerns सामने आए थे। उनका तर्क था कि enforcement mechanism इतना कमजोर नहीं होना चाहिए कि बड़े-scale tax evasion पर deterrence कम हो जाए।
इसलिए आगे का challenge होगा कि:
Business-friendly GST और Strong Anti-Evasion GST के बीच balance कैसे बनाया जाए?
Government और Business के रिश्ते में क्या बदल सकता है?
GST का पहला बड़ा objective था भारत के fragmented indirect tax structure को एक unified system में बदलना।
अब अगला objective दिखाई दे रहा है—taxpayer और tax administration के बीच friction कम करना।
अगर GST system ज्यादा automated हो, notices standardised हों, refunds तेजी से मिलें और criminal provisions सिर्फ serious fraud तक सीमित रहें, तो business-government relationship ज्यादा predictable हो सकता है।
लेकिन इसके लिए technology और data quality भी उतनी ही मजबूत होनी चाहिए।
सरकार खुद process reforms को technology और better-quality data से जोड़ रही है—यानी system जितना ज्यादा automated और data-driven होगा, उतना ही कम manual discretion की जरूरत होगी।
GST 2.0 का अगला Phase कैसा दिख सकता है?
57th GST Council की recommendations से एक broader picture सामने आती है।
GST का अगला phase शायद तीन pillars पर ज्यादा dependent होगा:
1. Simplification
Businesses के लिए registration, returns और refunds आसान करना।
2. Technology-led Compliance
Data और automated systems के जरिए गलतियों और fraud को identify करना।
3. Trust + Targeted Enforcement
Genuine businesses को unnecessary criminal pressure से बचाना, लेकिन deliberate fraud के खिलाफ strong prosecution बनाए रखना।
यानी सरकार का approach यह हो सकता है कि हर taxpayer को potential offender मानने के बजाय technology से risk identify किया जाए और enforcement वहीं focused हो जहां वास्तविक fraud के संकेत हों।
क्या यह Reform Business के लिए Game Changer होगा?
अगर recommendations को कानून में प्रभावी तरीके से लागू किया जाता है, तो इसका impact सिर्फ tax department और businesses तक सीमित नहीं रहेगा।
Faster refunds से working capital improve हो सकता है।
Simpler registration से new businesses को फायदा हो सकता है।
Higher prosecution threshold से smaller disputes में criminal risk कम हो सकता है।
और targeted enforcement से tax evasion के खिलाफ resources ज्यादा efficiently इस्तेमाल किए जा सकते हैं।
लेकिन final success implementation पर depend करेगी।
GST 2.0 का असली test अब tax rates नहीं, बल्कि trust, technology और enforcement के बीच सही balance बनाना होगा।
57th GST Council की recommendations इस दिशा में एक बड़ा कदम हैं—जहां Government का लक्ष्य सिर्फ ज्यादा tax collect करना नहीं, बल्कि ऐसा tax ecosystem बनाना है जिसमें compliance आसान हो, fraud पर action तेज हो और genuine business को unnecessary fear के बिना grow करने की जगह मिले।
